Terms & Conditions
These terms and conditions are valid from the 1rst of June 2014 (version 1.1).
Preamble
This site in its entirety, including all rights pertaining thereto, is the property of Génération Robots. Reproduction in whole or in part of the site is strictly prohibited without the prior consent of its owners. However, hypertext links to the site are authorised and do not require prior approval.
1. Acceptance of Terms and Conditions
The customer duly acknowledges having read the special conditions of sale set out on this screen at the time of placing an order, and expressly accepts these conditions of sale without reservation. These terms and conditions of sale govern the contractual relationship between Génération Robots and the customer and are accepted unreservedly by both parties. These terms and conditions of sale will take precedence over any other conditions appearing in any other document unless a prior, express and written exemption has been established.
2. Products
The majority of products offered by Génération Robots to its customers are available in our warehouse.
3. Order
The automated order entry system will be considered to constitute proof of the nature, content and date of the order. Génération Robots confirms its acceptance of the order by sending an e-mail to the address provided by the customer. The sale will only be completed once the order has been confirmed. Génération Robots reserves the right to cancel any order from a customer with whom a dispute exists over the payment of a previous order. The buyer is bound by the information he provides when placing an order; if the buyer provides incorrect recipient contact information, the seller cannot be held liable for not being able to deliver the product.
4. Delivery
Once the order has been confirmed, Génération Robots undertakes to deliver all the items ordered by the buyer to its carrier. For its part, the carrier is bound by contract with Génération Robots to deliver the order to the buyer’s address as provided by Génération Robots. In the case of cash-on-delivery payments, the customer agrees to pay the carrier or his agent the full amount specified in the order confirmation. In addition, for deliveries outside metropolitan France, the customer undertakes to pay all import taxes due on products, as well as customs duties, value added tax and any other taxes payable pursuant to the laws of the country to which the order is to be dispatched. All orders placed with Génération Robots are intended for the customer’s personal use. The resale in whole or in part of the product(s) by the customer or the recipient is forbidden. Génération Robots will not be held liable for the non-payment of taxes by the customer.
Remote areas: Certain localities or communes may be considered by transporters as "remote areas" and are then subject to a surcharge of €20 excluding VAT. The application of this surcharge cannot be predicted by the transport cost calculation tool of the Génération Robots merchant site. Génération Robots reserves the right to claim this sum from the buyer after validation of the order. The buyer will have the choice to pay this amount to Génération Robots, or to request cancellation and refund of the entire order.
Click & Collect: If you have selected the Click & Collect delivery method, please note that you must pick up your order at our premises in Mérignac, France. You must present yourself with an ID and your order confirmation. Your order will be available 2 hours after your purchase on our website (during opening hours, subject to stock availability).
Items to be delivered within metropolitan France will be routed by the French mail service by Colissimo Suivi (tracked delivery) or, if specifically requested by the customer, by Chronopost (express delivery). Items to be delivered to other countries will be routed by tracked delivery or, if specifically requested by the customer, by UPS (express delivery). The product(s) will be delivered either directly to the recipient indicated or, in his absence, to another person authorised by the customer to receive the product(s). In accordance with the Consumer Code, the customer may cancel the contract if the delivery date is exceeded by more than 7 days and not due to force majeure.
Items to be delivered within the European Union will be sent by the French mail service by Colissimo Suivi Europe (tracked delivery) or by DHL (express delivery), depending on the choice of the customer. Items to be delivered outside the European Union will be sent by the international mail service or by UPS, depending on the choice of the customer.
The customer will check that any technical products ordered function correctly, and undertakes to read the instructions supplied by the seller.
In the event of an apparent defect, the buyer may return the product(s) according to the conditions set out in these terms and conditions. Instances of force majeure, releasing the seller from all delivery obligations include war, riots, fire, strikes, accidents and the inability to obtain supplies.
The customer is advised to systematically check parcels upon delivery, and to refuse any damaged parcels. Missing or damaged items must be reported by the customer to the carrier within 48 hours of delivery. For availability reasons, an order may be delivered to a customer in several partial shipments. In this case, the customer only pays for one delivery. If the customer wishes products to be delivered to two different locations, then two separate orders must be placed and their associated delivery charges will be invoiced.
5. Withdrawal
In accordance with the European Consumer Code, the customer who lives in the EU (except for professional customers) has 14 days (from receipt of the items, with the tracking provided by the carrier as proof) to exercise his or her right of withdrawal, without the need for justification. In the event of an exchange or refund, it is advisable to return the new items, intact, in their original condition (never assembled) and in their original packaging, accompanied by all possible accessories, instructions and documentation to the following address

In case of exercising the right of withdrawal, Génération Robots is obliged to reimburse the sums paid by the customer (again, this only apply to EU residents). In the case where the customer has chosen for the initial shipment of the products an express delivery method, the reimbursement of transport costs will be limited to the amount of the least expensive shipping costs for the chosen delivery zone. The consumer must pay the return shipping costs in case of withdrawal. If you return only part of your order, you will be refunded the price of goods returned + delivery fees in proportion to the number of items returned.
Refunds are due within a maximum of 14 days following receipt of the items, in the above-mentioned condition. Refunds will be made using the same method of payment used at the time of purchase.
In any case, no shipping costs refund will occur for clients living outside the EU.
For professionals, the customer has 7 days (from receipt of the items, with the tracking provided by the carrier as proof) to exercise his or her right of withdrawal, only if there is a product failure. The customer must open a support ticket by writing to us at contact (at) generationrobots.com and upon approval of our service department, and only upon approval, we will take back the product and repair it, at our expense. Within Europe, return shipping costs are covered up to a flat rate of €400 excluding VAT. Outside Europe, they are at the customer's expense. After this period of 7 days, the professional customer may request a repair at his own expense.
6. Price
All prices are quoted in euros. The prices shown on the product description do not include shipping. The price quoted in the order confirmation is the final price, and includes all taxes and VAT applicable in France and in the countries of the European Union. This price covers the cost of the products, handling, product packaging and storage, delivery and commissioning.
7. Payment
The price charged to the customer is the price quoted on the order confirmation sent to the customer by Génération Robots. Products are payable in full on the day of the order. Payments are to be made by a credit card bearing the initials CB.
The P@iement CIC credit card payment system enables you to make credit card payments via a secure CIC bank server.
Your credit card number is routed to the bank’s servers, and your payment is processed directly in a secure bank environment without transiting through the online shop’s server. This serves as a particularly important guarantee insofar as your payment and credit card details are known only by our banking partner, who then simply informs us if payment has been successful or not.
Once validated by the customer, the order will be considered effective only once the bank has approved payment. If payment is refused, the order will be automatically cancelled and the customer notified by e-mail. Furthermore, Génération Robots reserves the right to refuse any order from a customer with whom it is in dispute.
8. Disputes
This contract is subject to French law. Génération Robots cannot be held liable for any tangible or intangible damages or bodily injury that may result from the malfunction or improper use of the products sold, or that might result from any possible changes made to the products by their manufacturers.
In the event of disputes arising from the implementation of this contract, the buyer may, before undertaking any legal action, seek an amicable solution and call upon assistance from an industry trade association, a consumer association or any other advisory body of his choice. It is understood that the search for an amicable solution does not in any way affect either the warranty or statutory limitation period. In general, and subject to the discretion of the Courts, compliance with the provisions of this contract relative to the contractual warranty supposes that the buyer honours his financial commitments towards the seller.
Favourable consideration will always be given to any complaints or disputes, as it is always assumed that customers taking the trouble to expose their situation are acting in good faith. In the event of a dispute, the customer should first contact Génération Robots to reach an amicable solution.
9. Warranty
In no event may Génération Robots be held liable for non-compliance with the regulations and laws in force in the country to which products are to be dispatched.
In all events, the customer benefits from the statutory warranty covering third-party rights and hidden defects (Art. 1625 et seq. of the Civil Code). Should the buyer prove the existence of a hidden defect, the seller is legally bound to compensate for all consequences (Art. 1641 et seq. of the Civil Code). If the buyer institutes legal proceedings, he must do so within a “short period” of discovering the hidden defect (Art. 1648 of the Civil Code). Professionals benefit from a 1 year warranty from the date of the invoice.
10. Governing Language
The governing language of these terms and conditions of sale is French. Only the French version of these terms is legally binding. Any disputes arising from these terms and conditions of sale shall be resolved with reference to the French version. The English translation of these terms and conditions of sale is provided for information purposes only.
11. Legal Information
The collection of personal data for the purposes of distance sales is mandatory. This information is indispensable for the processing and routing of orders, and the issue of invoices and warranty contracts. Orders cannot be confirmed without this information. In accordance with the provisions of the French law related to Information Technology and Civil Liberties, the processing of personal customer data has been declared to the French Data Protection Authority (CNIL). According to Art. 34 of the law of 6 January 1978, customers are entitled to access, modify, rectify and delete their personal data, and may exercise this right with regard to Génération Robots.
12. Recycling
The Unique Identification Number (UID) of Generation Robots (AGEC Law Art. R 541-10-9) is FR006657_05WLOG.
